Cabscan Now Closing

Due to a possibility of privacy breach, I am now closing down cabscan site until further notice.

Some person has made a complaint re my site.

Here is a copy of the email I received today



PRIVACY COMPLAINT

I am writing to advise that the Privacy Commissioner has decided to conduct an own motion investigation under section 40(2) of the Privacy Act 1988 (Cth) (the Act) into the website http://cabscan.bounceme.net/. The aim in conducting this investigation is to establish if http://cabscan.bounceme.net/’s practices are consistent with the Act.

I note that the Privacy Act regulates many private sector businesses in Australia, but there are exemptions. In particular, many small businesses are exempt from the Privacy Act. A business with an annual turnover of $3 million or less is a small business operator and so is not covered by the Privacy Act unless certain circumstances apply. These circumstances are described in the statements in question 4 below.

I am therefore seeking to first establish if this Office has jurisdiction to investigate http://cabscan.bounceme.net/. To this end I would appreciate if you could answer the following questions:

1. Are you responsible for the website http://cabscan.bounceme.net/?

2. If no, could you please advise who is responsible for the website?

3. If yes to question 1, has http://cabscan.bounceme.net/ had an annual turnover greater than $3 million in any financial year since 21 December 2001?

4. If not, please advise if any of the following statements are true for http://cabscan.bounceme.net/:

a) it is related to a business (that is, its holding company or any subsidiary company) that has had an annual turnover greater than $3 million in any financial year since 21 December 2001;

b) it discloses personal information about another individual to anyone else for benefit, service or advantage (unless it does so with the consent of the individual concerned or is required or authorised to do so under legislation);

c) it provides a benefit, service or advantage to collect personal information about another individual from anyone else (unless it does so with the consent of the individual concerned or is required or authorised to do so under legislation); or

I would appreciate receiving your written response to the above questions by close of business on 13 February 2009.

If I get the ok from the privacy commission I will start my site again.

You should be sweet though ? cause all thats saying is that your a business making a profit which you arnt so all's well ?

Hmm... wonder who it was aye :roll:

Thats bad news man... but yeah hopefully you will be alright and back up and running in no time... you hav :) e all of my, and surely everybody elses support.

I'll second that.

From what I just read there's nothing wrong coz you aren't gaining a profit and you aren't relating any info to individuals and most importantly you aren't a business.

Yeah good site, im supporting you as well BG.

Pretty much what I think it is. Is the government have managed to get the address from an emergency service database.

Anyway I am sure shane will be recieving information from the member who I believe didnt intentionally cause it, but it was just a mistake.

But of course others may think differently...

Maybe,

The only way i can think of it is their relating the services to be an individual.

Sorry mate, hope you get it back up and running. I had it as one of my favourites and was always good for an interesting read

Does anyone else have one up (tho I spose now they'll wanna keep it on the down low :D

Alot of guys on here have their own pager stream setup however they just run it from home and its not uploaded to the net.
Mine was all run from home, now its gone

The Privacy Commission has decided not to take any action against my site.
As it has been shut down, but they will now close the file on my site.
But they stipulated if they received any complaints they will reopen the case.

Guess I was lucky, but my site will NOT be open to public access again.

Sorry to all those that enjoyed it, but an action by a individual has now closed it for the rest.

BG,

Its good to hear that they are not taking any action on it.. maybe you will need to put it on a password protected website and be careful who you pass that privilage onto..
